Since 1925 the Composers, Authors and Publishers Association of Canada Limited has served its composer, author and publisher members, the users of music in Canada and the Canadian public. The protection of the property right inherent in musical compositions and lyrics in the performing right field can only be effectively accomplished through a central organization such as CAPAC. The users of music benefit from CAPAC’s administration inasmuch as without such an organization any user would have to clear thousands of musical works individually rather than through one central body and the expense of such indi¬ vidual clearance would far exceed the cost of a blanket license issued by CAPAC which authorizes the performance of any or all of some millions of works. CAPAC distributes the fees it collects amongst com¬ posers, lyric writers and publishers whose works are per¬ formed in Canada without any deduction whatsoever other than the actual cost of overhead which is maintained at approximately 14y2%. In any given distribution payments are forwarded to Canadians as well as citizens of some thirtytwo countries throughout the world and the Canadian mem¬ bers in turn receive payment from societies in these countries through CAPAC for performances of Canadian works abroad. The Canadian public benefits as a result of CAPAC’s existence inasmuch as the holders of the CAPAC license are able to present to music lovers throughout Canada selections from the world library of music without fear of infringing copyright.
