September 19, 1931 COmilSSION DENIES SIX APPLICATIONS Sustaining the reports of four of its examiners, and reversing the recommend¬ ations in two other cases, the Commission this week denied the re(puests of six ap¬ plicants. Three existing st-'tions were denied authority to increase operating hours, while the request of three other applicants to erect new stations were re¬ fused. In the first formal notice tha.t the Commission viev.’s ^/ith favor the recommended mileage separ'^tion tables now used by the Engineering Division in computing pro¬ posed operating distances, the request of Station Highlo,nd Pa.rk, Mich, to increase operating hours from sharing time with Station h'lBM to unlimited time was denied, reversing the recommendation of Examiner 'Falker (Report No. 182). The Commission in concluding its grounds for decision stated th^.t while the applicant ■'ind the respondent in this case had both conducted tests ^s to the possibility of interference to be expected from simultaneous operation, and little evidence of interference was found , nevertheless the recommended separation of stations operat¬ ing as requested is 260 miles and the actual separation is only 68 miles. "In view of this sound engineering fa.ct, little probative value can be given to tests conducted by the a.pplicant and respondent," the decision said. The Commissi.on further found that Station "'JBK was rendering satisfactory service with its pre¬ sent assignment. The application of C. E. King, Hutchinson, Kccnsas, requesting authority to erect a new stationon 1240 kc with power of 500 watts and daylight operation was denied, sustaining the report of Examiner ^alker (No. 192). The Commission found the city of Hutchinson is now receiving good service from a "number of stations." The equipment proposed by the application does not conform, to the Commission reguI'^.tions, nor would it be capable of rendering good service, if installed, it was found. It w^s further held that granting of the application would work a viola¬ tion of the Davis Amendment. Basing its conclusion on the failure of the applicant to specifically show the type and character of service he proposed to render, the Commission denied the application of Thom-’S F. Harkins, "^pper Darby, Pa. for authority to erect a new station on 900 kc with power of 250 watts and daylight operation, sustaining the recommendation of Examiner Hyde in Report No. 187, The Commission further found this community is now receiving satisfactory service from a number of stations '=',nd the granting of the application would result in intereference to other sta¬ tions operating on the requested and <^djacent frequencies. Admitting the applicant is rendering a commendable program service, but deny¬ ing that the shov/ing at the hearing was sufficient to reduce the schedule operat¬ ing hours of Station ^’'HBO, the Commission denied the application of Station ’v’TCC , North Shore Church, Chicago, Ill, for permission to increase its oper.^ting hours to 19 hours weekly. The recommendation of Chief Examiner Yost '/.-as reversed in this case (Report No, 188). The Commission found the program proposed is much the same type as is now being broadcast and no showing was made indicating the need for the additional service. The State University of Iowa, Iowa City, Iov;a, Station ’’^SUI, was denied authority to increase hours of operation from half time to unlimited hours, sus¬ taining Examiner Pratt (Report No. 191), The Commission found the community in ’"hich the station is located is now receiving good service and while this applicant renders good service, nevertheless it only proposes to use 12 hours a day, or tv.’othirds of a full broadcasting day of 18 hours.
