The examiners were reversed in tv/o cases. With two Commissioners dissenting, the Commission rev '.rsed Examiner Pratt (Report Ho® 176) and granted a renewal of license to station WEVD, op uated hy the Dels lleraorial Ifuid, Inc. Hew York City. After a recommendation of denial "bjr the examiner, the applicant petitioned for and was granted oral argument "before the full comnission on Septem"bor 26th. Chairman Saltzman o"bjected to the granting of the renewal on the groimd tlmt the station load grossly violated the regulations of the Commission in a number of instances and no satisfactory explanation has been given with rospect to those infractions® The Commissioner further objected to the obsolete equipment now in uso and said no evidence had boon introduced to show sufficient funds wore avail¬ able to modernize tho apparatus. In his dissenting opinion, Commissions Starbuck concurred with tho Chairman, and ansv;crod tho contention of the applicant claiming the right of an active minority for a pla,cc in broadcasting, with tho statement: "A minority is not a' thing apart and entitled to proforontial treatment as of right. A minority has a proper place but its 'ixistonce cannot justifiably be made an excuse to abuse tho privileges granted to it by tho government under v/hich it so exists, " The Commission found the primary considsation in the application of station WCKY, Covington, Ky to increase operating hours to uiilimited time to be "wh^ithcr or not tho public inter'-ist coiiv'^snionco or necessity would be s-sved by authorizing station WChY to operate unlimited time to the consequent deletion of stations WJAZ andWCIil, Chicago, Ill. and forfeiture of facilities novr assigned thtise stations." Examiner Walk'^.r (Report Ho. 186) had recommended to the Commission the request for unlimited time on tlr': part of the Kentucliy station be denied, since "tho granting of the application would further increase the quota of an over quota state." Tlais action of the Coimnission would seem to ignore previous construction of G-eneral Or¬ der 102, as placed on it by tho Examiner, Finding tho applicant is r^’indoring a varied and meritorious program service to tho listeivirs in the area, the Commis¬ sion granted the application concluding "tho time division nov; existing botweon station WCEY and stations WJAZ and WCHI is a liandicap to tho applicant station, from both financial and operating standpoints," The application of tne He^Tport, Rhode Island, station, miBA, for renewal of license was denied by the Commission, sustaining the findings of Examiner Walker (Report Ho. 222). Tne station nas boi'in licensed to op'^rate on 1500 kc with power of 100 watts and unlimited time. The Conunission refused tho license duo to violations of regulations, as well as finding that tho deletion of tho station woulo. no 0 deprive tho listening public, in that ar ;a, of any radio service.
