FCC announced its Memorandum Opinion and Order of June 13 which denied a July 30, 1956 petition by WMBD, Inc., unsuccessful applicant in Peoria, 111., ch. 8 comparative proceeding for rehearing, reconsideration and grant; however, in lieu of a grant on ch. 8, WMBD is authorized to construct a new tv station in Peoria on ch. 31, subject to engineering conditions and that it files within 30 days necessary technical information with respect to operation on ch. 31, that construction shall commence only after specific authorization by the Commission following submission of that information, and that acceptance by it of the instant grant shall be deemed to constitute a surrender by it of all asserted rights with respect to Channel 8. The Commission treated the alternative request contained in its July 30, 1956 petition in conjunction with the data contained in the application which was considered in the comparative hearing as an application for a permit to operate on ch. 31 in Peoria.
