SINS” PRODUCERS
(Continued from Page 1) ver distribution rights to Sins of the Fathers, which it produced, from the Maynard exchange.
Maynard, represented by Kenneth Stratton, KC, of Lawson, Stratton, Green & Ongley, had asked for the stay as part of his position that the dispute ought to be referred to arbitration instead of being judged by the courts. Canadian Motion Picture Productions is being represented by W. J. P. Jenner, KC, of Jenner and Brunt.
A motion for an injunction to restrain Maynard from making any more commitments for exhibition of the film is still to be heard. The Canadian Film Weekly reported two weeks ago that this had been refused On being advised to that effect by Paul Maynard, who apparently felt that failure of the court to hear the motion was a favorable action. Readers got the impression that the motion for an injunction had been dismissed, which is wrong.
Sins of the Fathers, a sex hygiene film, was produced by Larry Cromien and directed by Phil Rosen in the studios of Quebec Productions Corporation at Ste. Hyacinthe, Quebec. World distribution rights were given to the Maynard company, which awarded USA handling to the Motion Picture Sales Corporation.
The film, said to have cost $65,000 to produce, played several engagements in Canada but was withdrawn in Ontario several months ago on the orders of the censor. This was done because of agitation carried on and inspired by the Health League of Canada and its director, Dr.: Gordon Bates. Dr. Bates endorsed the film at the time of its first showing, in Montreal, but withdrew his support on the contention that it had been changed later without consulting him. It has been heard unofficially that Maynard and Bates have gotten together and that the film will get a Health League okay, with a percentage of the receipts going tonite. :
The plaintiff’s claim, as given in the endorsement on Writ of Summons, is (a) for a recission of the agreement and for an accounting or in the alternative (b) rectification of the agreement so as to include certain clauses found in standard forms of contracts between producers and distributors, for an accounting and (c) an injunction preventing further exhibition commitments or granting of distribution rights until the trial of this action has been disposed of.
