ARBITRATION Appeal Board In the matter of arbitration between Herman Hunt and Maurice Chase, Vogue, Wyoming, O., and Loew’s, Inc., and involv¬ ing the Emery, Reading, O., the Appeal Board last week amended the original award of the arbitrator to read as follows: WE SCORE BOARD (In this department will be found a rating of pictures screened by Warners, MGM. TE In Dallas Suit Oklahoma City — Theatre Enterprises, Inc., Dallas, was last week drawn into the government’s monopoly suit against Grif¬ fith Amusement Company. RobeKt E. Shel¬ ton, U. S. District Attorney, filed 16 questions in federal district court deal¬ ing in part with the Dallas firm. The questions are directed to H. J. Griffith, a defendant in the nine-year-old case. Griffith is president of Theatre Enter¬ prises, Inc., to whom several houses once owned by R E. Griffith Theatres, Inc., and Westex Theatres, Inc., were sold after the death in 1943 of R. E. Griffith. Shelton aimed his questions to learn how much Enterprise stock is owned by H. J. Griffith. He also asks how much En¬ terprise stock is owned by four companies which the government charges with con¬ spiracy to monopolize the film business in Oklahoma, Texas, and New Mexico. These are Griffith Amusement Company, R. E. Griffith Theatres, Inc., Westex Theatres, Inc., and Consolidated Theatres, Inc. Edgar S. Vaught, federal district judge, scheduled further hearings in the case for Nov. 30. Last October, Judge Vaught ruled the companies were not guilty of conspiracy to violate Sherman anti-trust laws, but the U. S. Supreme Court later reversed the decision. Schenectady Tax Ignored Schenectady, N. Y. — A five per cent ad¬ mission tax was ignored by City Council last week in adopting its 1949 budget. Theatre operators, cooperating with civic groups, were successful in winning support against the measure. “In licenses hereafter entered into by Loew’s, Inc., the maximum clearance which may be granted to the Emery over the Vogue shall be seven days after the Emery’s availability.” Costs were equally assessed against the complainants and Loew’s, Inc. __ .
