Operators Accept Pact Continuing Cut Chicago — Chicago operators yesterday accepted a new contract from circuit and independent theaters, which will continue last summer's 10 per cent cut until March 1, 1939, when five per cent will be restored. BRYANT 9S600 Judge Bondy's RKO Reorg. Opinion Held Imminent (Continued from Page 1) to a late hour in the afternoon, the document was not forthcoming. Observers close to the situation held to the view that there is little likelihood that Judge Bondy will render an oral opinion from the bench at today's hearing which is slated to be held at 2:30 p.m. in Federal Court. That the hearing, however, will probably be the final one found no dissenters, since, it is pointed out, all briefs and evidence are in the Court's possession for the first time in the annals of the action. The last brief was filed on Wednesday, last. Today's session is expected to find "clean up" argument presented, it is learned. Judge Bondy, himself, intimated at the last hearing that it is very desirable to reach a decision before the present year ends. 3,500 Movie Quiz Entries Reaching Drive GHQ Daily Entries in the Movie Quiz contest are now pouring in at the rate of 3,500 daily, it was said yesterday at the Motion Pictures' Greatest Year, Inc., headquarters. Daily average has doubled each week for the last five weeks, with flow expected to reach avalanche proportions by the Dec. 31 deadline. Judges for the contest will meet about the middle of January and it is expected that the winners will be named by the end of the month or early in February. Newspaper advertising throughout the country will be used to announce the winners. Chicago Anti-Trust Hearing Set for Dec. 8 Chicago — Additional moves in the Department of Justice's criminal attempt proceedings against B & K and the majors, except Columbia, are now slated for Dec. 8. Action was deferred yesterday. B & K and Paramount attorneys presented a motion for a bill of particulars, also a bill to squash subpoenas. Action on these also was put over for seven days. Fred Pride and Otto Koegel are here from 20thFox New York offices in connection with the case. Tri-State MPTO to Meet in Memphis on Dec. 11-12 Memphis — Annual convention of the MPTO of Arkansas, Mississippi and Tennessee will be held here Dec. 11-12. Weeks on Exchange Tour George W. Weeks, Monogram's general sales manager, left yesterday for a tour of eight exchanges. He will visit Atlanta, New Orleans, Dallas, Oklahoma City, Kansas City, Omaha, Des Moines and Chicago. Weeks is due back in New York about Dec. 15. H. M. Richey a Witness at Indianapolis Trust Suit Indianapolis — Edmund H. Bingham was the first defense witness at the trial in Federal Court yesterday of the old Indianapolis Amusement Co.'s damage suit against the majors, the MPPDA, the Indianapolis Film Board of Trade, in which the plaintiff seeks to establish that block-booking is a violation of the anti-trust law. Bingham told of exorbitant salaries paid by the Indianapolis Amusement Co., its methods of conducting business and its general conditions. Plaintiff objected to this testimony, causing delay in the trial. H. M. Richey, RKO witness for the defense, described the adoption of uniform contracts in 1922-23 by the exhibitor organizations, activities of the association, methods of arbitration between producer and exhibitor. Charles Reagan and Sam Sax of New York and Harry Bailey of Toronto were present at the trial which is expected to continue over the week-end. Marcus Loew's Theaters, Ltd. Reports Yr. Net of $125,547 Montreal — Net income of Marcus Loew's Theaters, Ltd., in the year ended Aug. 31 was reported yesterday at $125,547, compared with $111,731 in the fiscal period ended Aug. 26, 1937. Operating profit was up from $188,448 to $201,158. Surplus account rose $68,332 to $822,262 after payment of $57,216 in preferred dividends. Working capital advanced from $264,988 to $70,538 with cash amounting to $400,550, against $290,830. Loew's London Theaters had income of $15,722 in the year ended Aug. 25, compared with $15,597 in the preceding 52 weeks. Working capital declined to $41,003 from $69,575. iii 1 (S ! WILLIAM F. CEORGE SMITH, Western district manager for Paramount, sails from Hollywood, Dec. 7, with his wife, for Honolulu. Para.
