Charge Balk to Indie Building in Capital

ROBERT BORSTOCK. Capitol, Pottsville. SALVATORE LEONE. Capitol, Pottsville.
Burka Theaters, Inc., a local neighborhood circuit with four houses and two under construction. Conspiracy with distributors for the best breaks in neighborhood runs is charged.
A similar suit was filed last week by Sidney Lust, another local circuit operator.
Charge Indie Building Balk
A history of alleged Warner moves to balk independent building in newly developed suburban areas was related in the complaint.
The complaint charges that Warners last year entered into a conspiracy with Kass Realty Co. and Garfield I. Kass, designed to keep independent theater operators from constructing or acquiring any additional theaters in the District. Kass announced early in 1944 plans to construct 10 or 15 new theaters in the District. In this announcement practically every available site where a new neighborhood theater might be constructed was preempted. No action was taken by the defendants to construct any of the theaters mentioned in this announcement, K-B alleges, except where an independent got ready to build near one of the sites. Whenever that happened, the defendants immediately started to build in opposition, relying upon the earlier announcement to show they were there first.
Competitive Building
Last February K-B announced plans to build a new theater to be known as the MacArthur. When a building permit was obtained, Warners announced in August that it was about to commence construction of a competing theater on MacArthur Boulevard three blocks away, also to be known as the MacArthur. The complaint charges that construction was started on this theater before it was authorized by WPB and that the construction is being undertaken for the purpose of driving plaintiff
off and as a warning to other independent exhibitors of what they might expect in like circumstances. The complaint charges that each time K-B undertook construction of a theater in the district during the past seven or eight years K-B was faced with a similar action on the part of the Wamer organization. When the Atlas was built in Northeast Washington, the threat was carried out and the Beverly was constructed as an opposition theater. The Atlas has been kept in an inferior position ever since. The threats made when the Apex and the Senator were about to be built were not carried out.
Para, to Seek to Find "Regular" Philly Outlet?
Philadelphia — With the first-run Fox Theater at 16th and Market Sts., currently operated by Warner Bros., reverting to 20th-Fox on Friday, with Harold Seidenberg remaining as managing director, speculation is current that Paramount may seek to find a "regular" first-run outlet for itself.
A move by other film companies to negotiate for some of the Warner first-run houses to assure themselves of regular "showcases" was also viewed as a possible measure to combat the strength displayed by William Goldman with his Keith's and Karlton on Chestnut St. and the new house being built on 15th St.
Warners announced yesterday that it will drop two theaters from its operation in Philadelphia, the New Park, at 31st and Diamond Sts., and the Jefferson, now closed, at 2217 N. 29th St. upon the expiration of the present lease, Nov. 30.
It is reported that Warners relinquished the leases due to inability to make satisfactory terms on the renewal. The houses are owned by the Kapner estate.
