Benjamin of New York, representing Pathe Laboratories, Inc. declared that Pathe although it holds a first and unencumbered lein for entire indebtedness due it has every desire to help the unsecured creditors whose claims amount to $40,000. He further stated, Pathe has no inclination to foreclose on its security or take any other steps prejudicial to either the creditors or officers of Producers Pictures Corporation and he denied a published report that Pathe is insisting on Ben Judell's withdrawal. Creditors' committee representing Agfa Cinema Props Co., International Studio Equipment, Inc., and Quigley Publications was named to cooperate with Pathe in working out a favorable solution of present difficulties. Benjamin stated that the many distributors of Producers Pictures Corp. have expressed their anxiety for continued production, and Pathe therefore is considering several proposals for these purposes. Pathe claim against Producers Pictures Corp. represents $90,000, which is protected by seven pictures already completed, of which one is "Goose Step," formerly "Beast of Berlin," and early grosses on the picture are very favorable. Postpone Yamins Dinner; Now Scheduled in March Boston — Postponement of the Nathan Yamins testimonial dinner, scheduled for the Hotel Statler next Tuesday, was announced yesterday. Yamins, former head of both national Allied and its New England affiliate, Independent Exhibitors, Inc., is now chairman of the latter's executive board. Morris Pouzzner of Regional Theaters, Frank Perry of Orpheum Theater, Foxboro, and Wilbur Peterson of Orpheum Theater, Somerville, the committee in chargre. indicate that the testimonial will probably be held early next month. Yamins is now out of town. GN Trustee Wants Control of Property in England Joseph Dannenberg, attorney for the trustee of Grand National, examined F. G. Holleran, vice-president of the National City Bank, yesterday at a hearine before Referee Peter B. Olney. Holleran testified concerning a $25,000 loan made to the company. On the same day Referee Olney granted permission to the trustee to retain Hollander & Bernheimer to obtain possession, for the trustee, of GN property in Great Britain. Carroll, Aherne Feted at Music Hall Reception Gus Eyssell, Leon Leonidoff, R. V. Downing, Erno Rapee and Russell Markert hosted a cocktail reception in the studio apartment of the Radio City Music Hall last evening for Madeleine Carroll and Brian Aherne, stars of UA's "My Son, My Son," which is soon to be released nationally, and also set for Music Hall showing. Among the large representation of local Film Row personalities, ineluding the trade and daily Press, were Arthur W. Kelly, Lynn Farnol, Jack Alicoate, John Herts, Jr., Al Margolies, Sammy Cohen, Al Wilkie, Don M. Mersereau, Rutgers Neilson, Cal Swanson, J. J. Y. — Local 376, IATSE, went swank to mark its 25th anniversary, tossing a banquet in the grand ballroom of the Hotel Syracuse. Event attracted nearly 300. Among those on the dais were Fred S. Boukhout, or Rochester, prexy of the state projectionists association; Glenn Humphreys, secretary of the 10th district, IATSE; Mayor Rolland B. Marvin, Fire Marshal; Charles JWilkes and officers of the local. Invocation was given by the RevRrthur Merriman, former exhibitor, now a leading Episcopal rector here. Entertainment program included 18 acts of vaude. Three in Both Feb., March From Warners, Says Sears Warners will release three pix each during February and March, according to the latest release schedule announced by Grad Sears. Releases for February are: "Calling Philo Vance," 3; "Get Your Gun," 10; and "Castle on the Hudson," 17. There will be no release for the 24th. Set for March are: "Dr. Ehrlich's Magic Bullet," 2; "Three Cheers for the Irish," 16; and "Virginia City," 23. Condition of Al Steffes Shows Great Improvement Al Steffes. Northwest Allied leader now confined to the Providence Hospital, Washington, D. C, was reported to be "greatly improved" yesterday. Steffes was stricken while attending the Allied board meeting last month. Jean Muir Leaving AGVA Jean Muir, assistant executive secretary of AGVA, announced yesterday that she is resigning that post in order to fulfill a contract for Metro on the Coast. cominc MID G0MG ;aves I NATE J. Montreal Exhib. Again Admits Children; Fined Montreal — Minimum sentence of $50 and no costs, or one month in jail, was imposed on George Capadretes, owner of the Cameo Theater, when he pleaded guilty before Recorder Leonce Plante to admitting children less than 16 years of age to a motion picture hall. The record showed that Capadretes was convicted for the same offense last December. Accused was allowed until Feb. 15 to pay the fine. "Light" Set for Radio Ronald Colman, Ida Lupino and Murial Angelus will appear in a radio version of "The Light That Failed" on the Maxwell House program on Feb. 8, portraying the same rolls in which they appeared in Paramount's screen version. Two More Keaton Shorts West Coast Bureau of THE FILM DAILY Hollywood — Buster Keaton has been signed by Columbia to appear in two more" comedy shorts for release this season. This will bring the actor's current series to four for the company. He will also supervise production of the new tab reels.
