Motion to Strike Answers in H. & S. Sonn Suit Denied
Application of H. & S. Sonn, Inc., to strike out the answers of the White Plains Hamilton Corp., RKO Film Booking Corp., and RKO Service Corp., was denied Friday by New York Supreme Court Justice Philip J. McCook. H. & S. Sonn, Inc., had brought suit for $200,000 damages against the defendants for alleged breach of a lease under which the defendants were to pay 50 per cent of net profits of the RKO Hamilton Theater in White Plains, plus an annual rental to the plaintiff. The plaintiff charged in its motion the defendants with disobeying an Appellate Division order directing a sweeping examination of records of the defendants.

Holdovers on Warners "The Fighting 69th" were 100 per cent last week in all 365 situations where it has opened and is now playing, it was learned at the week-end. In 11 key cities, pix has been held for a third week.

Rodner to Select Stars
for Will Rogers Short
Harold Rodner, Warner exec, and vice-president of the Will Rogers Memorial Fund, leaves for the Coast tonight to supervise the selection of stars and the arrangements for the filming of the annual Will Rogers short subject. Reel will be shown in theaters throughout the country during Will Rogers National Theater Week, beginning April 18. Pix will again be filmed at one of the major studios.
Gable, Tracy, Colbert and Lamarr for "Boom Town"

Aussenberg Named European Representative for DeVry
Appointment of Julius Aussenberg as English and general European representative for the DeVry Corp. was announced Friday by Herman DeVry. Aussenberg was general European representative for 11 years for William Fox and has also been interested in production on the Coast. Date for his departure is indefinite.
