Jackson Park Asks Increase in Damages
Chicago. July 9. — With the lega battles in the Jackson Park anti-trust suit continuing, the plaintiff claims that damages also continue, in conse quence of which it asks that $600,000 compensation be added to the $360,000 already awarded.
Meanwhile the nine defendants which include five distributors and Balaban and Katz and the Warner circuits, yesterday asked the U. S Circuit Court of Appeals here for a rehearing on the case. Miles Seeley, defense attorney, said that if the re hearing is refused his clients would take the case to the U. S. Supreme Court.

Reasons for the collapse of Miss Pickford's negotiations with Si Fabian, Eastern circuit operator, and Serge Semenenko, of the First National Bank of Boston, for the sale of her half interest in the company were not disclosed. The sale was reported to have been on the verge of closing late Tuesday, and Fabian had gone to Miss Pickford's hotel here prepared to sign the papers, only to be told upon his arrival that the deal was off.
In a joint statement issued by Miss Pickford and Fabian yesterday announcing the "discontinuance" of the negotations it was stated only that "certain insurmountable legal hurdles were encountered which make the proposed deal impractical. The termination of negotiations is completely amicable among all parties and has been concluded with mutual admiration and regard,'' the statement concluded.

Rapp described three alternative courses by which Paramount could carry out the terms of the decree re quiring five film companies to divest themselves of theatres in which their stock is more than five per cent and less than 95 per cent by Dec. 31, 1948. All of these transactions would be subject to a conversion tax, Rapp said, under existing U. S. law.
Major Interest
"Paramount has by far the major interest in remedial legislation," Rapp stated, since it has interests in approximately 1,000 theatres affected by the decree.
Declaring that his was only a preliminary appearance, Rapp asked permission to submit a more detailed memorandum to the committee and to the joint committee on taxation, also to the Treasury. He also asked for a conference with the joint committee and treasury staffs so that he could propose more concrete legislation to them.
