A modified reorganization of the state group was undertaken several months ago in Albany, when a ses- sion for the eastern section was com- pleted and the western setup of the organization agreed on. Max Cohen, a Brooklyn exhibitor and not the Cohen who withdrew from this Allied organization to join the Allied Theatre Owners of New York, and Robert Goldblatt, of Tar- rytown, were placed on the commit- tee representing the N. Y. area at that time. Abraham Stone, of Al- bany, and attorney Leonard Rosen- thal, of Troy, were picked from the Albany area. H. P. Nick and Weston Lose Appeals, Must Serve S-year Prison Terms St. Louis, Sept 2. John P. 'Big* Nick and Clyde Weston, former execs of lATSE, Local No. 143, must serve five-year jolts in the pen and pay lines of $10,000 each for violating the Fed- eral labor anti-racketeering act, ac- ording to the decision of the U, S. Circuit Court of Appeals filed here Saturday (30). Convicted on Sept. 18, 1940, in U. S. District Court after a trial lastmg a week, Nick and Weston have been at liberty on bonds pending the appeal. "The Appellate Court overruled all contentions of error in the trial be- fore Judge John Caskie Collet, hold- ing specifically that the anti-racket- eering statute was constitutional. The high tribunal also overruled as unsound the contention of' the de- fense that the Federal act was un- constitutional in that it denied free- doih of speech in providing punish- ment for organized labor by making it a crime to communicate wage de« mands to employers. Holding that the law made it a felony to attempt to obtain money or property through coercion or by threats of force, or violence, the court pointed out that the law ap- plies only when labor leaders use their power for personal aggrandize- ment and not when in bona flde in- terests of their membership. 'Individuals may obtain power' in labor organizations,' the opinion re- cited, 'which is capable of use to obtain unwilling payments from em- ployers through bringing about or threiitening to bring about vio- lence, or through coercion.' Nick and Weston were charged in five counts with obtaining $6,500 from local flicker house owners in 1937 through exorbitant wage demands which were ditched after the pay- ment was made.
